TERMS AND CONDITIONS OF HIRE
These Terms and Conditions (“Terms”) constitute the entire agreement between Blue Fin Events Limited (“the Provider”) and the person, organisation or company making the booking (“the Client”). By placing a booking, whether verbally, electronically, or in writing, the Client confirms acceptance of these Terms.
These Terms supersede all prior discussions, representations, or agreements.
1. DEFINITIONS
Provider: Blue Fin Events Limited trading as Party Pics Photo Booths
Client: The person or entity booking the equipment
Equipment: All items supplied by the Provider
Hire Period: The operational period of the Equipment
Event Date: The date and time of hire
Event Location: The venue address where Equipment is to be installed
2. OWNERSHIP
All Equipment remains at all times the sole property of the Provider.
3. BOOKINGS & FORMATION OF CONTRACT
3.1 A booking is deemed confirmed when:
a) For private clients: a non-refundable booking fee (deposit) is received.
b) For corporate clients: written confirmation to proceed is received.
3.2 Once confirmed, the booking is final and subject to cancellation terms.
3.3 It is the Client’s responsibility to ensure the venue permits installation and provides suitable access, space and power.
3.4 The Provider holds valid PAT testing and Public Liability Insurance.
4. PAYMENTS
4.1 All hires require a non-refundable booking fee.
4.2 Private Clients:
Full balance payable no later than 30 days prior to the Event Date.
4.3 Corporate Clients:
Invoices payable within 30 days of invoice date unless otherwise agreed.
4.4 The Provider may charge statutory interest on overdue sums at 8% above Bank of England base rate plus a £70 late-payment recovery fee per invoice.
4.5 Failure to pay by the due date may result in cancellation without refund.
5. DATE CHANGES & CANCELLATIONS
5.1 Date change requests must be submitted in writing at least 28 days before the Event Date and are subject to availability.
5.2 If no alternative date is available, the booking is treated as cancelled.
5.3 All payments are non-refundable.
5.4 Cancellation charges:
- More than 8 weeks: booking fee retained
- 8–6 weeks: 50% of total hire fee
- 6–4 weeks: 75% of total hire fee
- Less than 4 weeks: 100% of total hire fee
6. ACCESS, DELIVERY & INSTALLATION
6.1 The Provider determines the final installation location following Health & Safety assessment.
6.2 The Provider may refuse delivery or setup if:
- Unsafe access exists
- Restrictions were not disclosed
- Distance from vehicle exceeds 50 metres
- Stairs, steps, tight corridors, lifts, or restricted loading were not declared
6.3 Failure to disclose access restrictions may result in refusal of setup and no refund.
6.4 The Provider’s vehicle is a 3.5-tonne Luton van (approx. 10ft height clearance). The Client must disclose any height or vehicle restrictions.
6.5 Venues requiring lift access must provide lift dimensions in advance.
6.6 Heavy items (photobooths, large kiosks, illuminated hearts) are not suitable for stairs or lifts.
6.7 Upstairs or lift access installs incur a £50 surcharge.
6.8 Equipment requires a flat, stable surface.
6.9 The Provider will not move venue furniture.
6.10 Equipment is normally installed at least 4 hours prior to event start unless agreed.
7. OPERATION & FAULTS
7.1 Any fault must be reported within 1 hour of discovery.
7.2 If a Provider-caused fault cannot be rectified, a pro-rata refund applies.
7.3 No refund where faults arise from:
- Power failure
- Misuse
- Venue issues
- Client interference
7.4 Maintenance interruptions (paper/ink changes) do not constitute faults.
8. CLIENT RESPONSIBILITIES
8.1 The Client is responsible for:
- Venue coordination
- Crowd control
- Preventing misuse
- Supervision of children
8.2 No unattended children under 14 may use Equipment.
8.3 The Provider may cease operation immediately if safety, abuse, or threats occur, with no refund.
9. DAMAGE, LOSS & THEFT
9.1 The Client is fully liable for any damage, loss or theft of Equipment.
9.2 Repair or replacement costs will be invoiced within 7 days of the Event.
10. LIMITATION OF LIABILITY
10.1 The Provider accepts no liability for personal property loss or injury.
10.2 Maximum liability shall not exceed amounts paid by the Client.
10.3 If no Equipment is provided, refund limited to monies received.
10.4 Free add-ons carry no compensation or refund if unavailable.
10.5 Digital media liability is limited to £10.
11. FORCE MAJEURE
The Provider is not liable for failure to perform due to events beyond its control including severe weather, road closures, venue denial, accidents or medical emergencies.
Where prevented on the day, no refund shall be due; a credit note may be offered.
12. MEDIA & COPYRIGHT
The Client grants the Provider unrestricted rights to use all images for marketing, portfolio, and promotional purposes.
13. DATA DELIVERY
- Audio guestbook files: within 14 days
- Digital photos: within 28 days
- Delivered via third-party file transfer
14. SEVERABILITY
If any clause is unenforceable, remaining clauses remain valid.
15. GOVERNING LAW
This agreement is governed by the laws of England & Wales.
Jurisdiction lies exclusively with the courts of England & Wales.
